TERMS AND CONDITIONS OF SERVICE
These General Conditions of Purchase regulate the use of the website castaner.com (hereinafter "The Website") Distribuciones Calzado Banyoles, s.l., hereinafter Castañer, a commercial entity incorporated under the Spanish constitution, with registered office at c/ Menuts, 28 17820 Banyoles (Girona), registered in the Commercial Register of Girona, volume 1269, folio 173, page 21554, entry 2, with tax identification number B50667823.
The use of the services of the online shop presupposes adherence to the General Conditions of Purchase in the version published at the time of the purchase order. It is therefore advisable to read these General Terms and Conditions before making a purchase.
1. ACCESS TO THE WEBSITE
To make a purchase through the website, you must be over 18 years of age and have legal capacity to purchase the products offered on the website. For this reason, Castañer reserves the option to request documentation proving your age at any time. In the event that we verify that you do not have the required age or you do not comply with Castañer's request, or do not comply with it correctly, Castañer will prevent you from purchasing the product requested.
You do not need to be registered to access and browse the site. However, you can register and obtain exclusive advantages such as, for example, speeding up the process for subsequent purchases, for which you only need to provide your e-mail address and password.
The registration process is considered a formalisation of a legally binding contract between Castañer and the user, in accordance with the terms of this Legal Notice and the registration conditions included in it. As a registered user you acknowledge that you have read and understood the terms and conditions of this Legal Notice and the registration conditions included in it, and that you agree to comply with all its provisions. You also acknowledge that you have read and accepted the Privacy Policy.
2. PRICE AND METHOD OF PAYMENT
The price of the products will be the price shown in euros on the website and will include VAT and any other tax or duty applicable in the territory of application, as well as any shipping costs duly itemised in accordance with the provisions of the 'shipping and expenses policy'.
Castañer may offer discounts as part of certain special offers, although these discounts cannot be combined with other offers.
Castañer reserves the right to make any changes it deems appropriate to the prices of products. In any case, the price we apply to the purchase order placed will be the one stated at the time you accept the general terms and conditions of the selected product.
You can make a one-off payment in one of the following ways:
- Debit or credit card (Visa Electron, Visa, Mastercard, American Express, Maestro or others provided on the website)
- PayPal
- Klarna*
*In order to be able to offer you klarna's payment methods, you may have to enter your personal contact details and order details in the form on the payment tab, so that Klarna can evaluate and qualify the payment method used. Your personal data submitted through Klarna's form will be processed on the basis of its own privacy policy.
You must include the payment information required in the purchase procedure. The charge will be made once it has been accepted by the financial institution or platform through which the payment is made, otherwise the purchase will not be completed.
Subsequently, you will receive an e-mail confirming the purchase of the product and a copy of these general terms and conditions.
3. DELIVERY OF THE PRODUCTS
3.1. Delivery time
If the delivery of your product is in Spain, you will receive them within approximately one (1) to two (2) working days from the date of shipment, deliveries will be made throughout the day, the exact hour cannot be specified. For the rest of the European countries, the approximate delivery time will be from two (2) to four (4) working days.
Castañer may extend delivery times in periods of sales and high season or when an irregularity is detected in the order. The delivery period shall never exceed thirty (30) days from the date of order confirmation.
No deliveries will be made on Saturdays, Sundays and public holidays and will be made on the next working day.
The product order shall be binding when the customer confirms it in the purchase procedure.
3.2. Home delivery
Deliveries will be made to the place you have indicated in the purchase procedure as long as it is within Spain (except in the Canary Islands and Ceuta and Melilla) and also in the following countries: Austria, Belgium, Bulgaria, Croatia, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, the Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Sweden and the United Kingdom.
The product order shall be binding when the customer confirms it in the purchase procedure.
3.3. Delivery incidents:
We will deliver your products to the address you have indicated in the purchase procedure. If an error in the address is detected, the customer service department will contact you as soon as possible.
Shipping addresses must be physical locations accessible to courier companies. We cannot deliver to collection points or post offices.
If no one is at home at the time of delivery, the courier company will make up to three (3) attempts to deliver the goods. If your shipment is not delivered after these attempts, your order will be returned to Castañer and you will need to contact the customer service department to arrange delivery.
If you wish to change the delivery address after purchasing the product, please contact our customer service department using this form, indicating the order number and the correct delivery address.
At the time of delivery, you must confirm receipt of your order with the courier company.
3.4. Information on shipping costs
All orders placed on castaner.com and shipped within the European Union are free of charge. Rates are subject to change according to specific offers. You accept the rate in the order request.
In the event that the shipment has customs costs, these will be paid by Castañer: you should not pay any amount pertaining to customs.
Castañer reserves the right to modify these amounts and conditions.
4. AVAILABILITY
All orders for the purchase of products are subject to their availability. In case of unavailability of the contracted product, Castañer will inform you of this and may offer you a product of similar characteristics of equal or higher quality, although you can cancel the purchase request and recover the amount paid as soon as possible.
All other terms and conditions set out in the 'Shipping and Charges Policy' shall also apply.
5. WITHDRAWAL AND RETURNS
To return a product, please follow the procedure set out in the returns policy.
You have a period of 30 calendar days from the date of receipt of the product to exercise your right of return or withdrawal. These concepts are defined as follows:
- Return: in case of defect.
- Withdrawal: by decision of the customer
In order to manage product deliveries quickly and easily to Castañer, we offer you the express courier collection system for national deliveries (Spain). For shipments from countries outside Spain, a label is available to manage the return with dhl express. You will find detailed information by clicking HERE.
Returns are free of charge.
Castañer will accept returns if the product is in perfect condition and has not been used. To return the product you must use the original, undamaged box or packaging, or a similar container.
To make a return, fill in the form that you will find inside your order and send it to Castañer together with the product to be returned, with its box and its internal packaging or a similar container. We cannot accept returns without documentation.
When returning an item, we will always refund the amount paid on the day the purchase was made, in the same payment method used. Once we receive the item to be returned, we will proceed to its validation and reimbursement within 7 working days. The deadline for the refund to become effective will depend on the receiving bank. We recommend that you contact your bank for more information.
We do not make exchanges as such, so you will have to return the item and place another order with the new product. The prices of the articles can vary in periods of sales or special offers. If you want to make a change, the amount payable for the new purchase will be the rate in force on the day of the new order.

6. GUARANTEE OF THE PRODUCTS PURCHASED.
The guarantee offered by Castañer is the one established in the Royal Legislative Decree 1/2007, of 16 November, which approves the revised text of the General Law for the Defence of Consumers and Users. Therefore, any Castañer product has a warranty period of three years from the date of purchase.
If you are not satisfied with the product sold by Castañer, you must inform us as soon as possible and request the replacement of the product. In order to be able to request your right to a guarantee, proof of purchase is essential. We will also need photographs where the defect is evident.

This warranty does not apply to products whose defect arises from natural wear and tear or misuse.
We will repair or replace your product, provided that the hygienic conditions are optimal. If neither of the two cases is possible, we will refund the amount, in the same form of payment in which the purchase was made.
In case of return due to lack of conformity, the return costs will be borne by Castañer.
Please follow the instructions of the customer service department at all times in order to exercise your warranty rights.
7. RESPONSIBILITY
Castañer makes every effort to offer you accurate and complete product information that is as up to date as possible. Even so, the colour of the products that appear on the website may vary depending on the characteristics of the customers' devices. For this reason, Castañer reserves the right to rectify the images of the products when necessary.
Castañer will not be responsible for any errors that may occur in the delivery of products in the event that you have not correctly completed the purchase form provided on the website. If there is any incident in the delivery of the products, Castañer will inform the customer as soon as it becomes aware of it.
The risk of the products will be transferred to the customer from the moment they have been made available to him/her and, in the case of their return, they will continue to be at your expense until the delivery of these to Castañer.
SOCIAL NETWORKS
Castañer has profiles on social networks (Facebook, YouTube and Instagram), with the aim of informing about its products and providing updates about the company.
If you join any of the profiles opened by Castañer on social networks you must respect and comply with the terms and conditions of said social network.
Castañer can carry out the following actions:
- Access the public information of the user profile.
- Send individual messages through social network channels where permitted.
- Update the status of the profile to be displayed on the user's profile.
We may run competitions, promotions and prize draws through our social media channels.
ADVERTISING
Castañer may include on the website advertising content or sponsorship from third parties. Advertisers and sponsors are solely responsible for ensuring that the material submitted for inclusion on the website fully complies with the law.
Castañer shall not be liable for any error, inaccuracy and/or irregularity that may be included in the advertising content or that of the sponsors, nor for any failure to comply with current legislation.
LINKS POLICY

Third parties who intend to include on a website ("linking site") a link to the website, or a frame with the same, must necessarily obtain the prior written consent of Castañer.
The authorisation granted by Castañer does not mean that it endorses, promotes, guarantees and/or recommends the content or services of the linking site or that it is responsible for the content of the latter.
The linking site must comply with current legislation and may not, under any circumstances, host content, whether its own or that of third parties, which is unlawful and/or harmful (violent, racist, denigrating, etc.) and/or inappropriate or irrelevant in relation to Castañer's products and/or services.
In the event of non-compliance with any of the aforementioned terms, Castañer shall immediately revoke the consent granted to the linking site, which shall remove the link.

The website may contain various links that allow the user to access other websites ("linked sites").
Under no circumstances does the existence of linked sites imply the recommendation, promotion, identification and/or conformity of Castañer with the statements, content and/or services provided through the linked sites.
Castañer is not responsible for the content, conditions of use, privacy policies, and other conditions of the linked sites, and the user is solely responsible for checking and accepting them each time he/she accesses and uses them.
8. COMPLAINTS AND CLAIMS
You can contact us through the means indicated in the "legal notice", to express your complaints and claims, where you will also find a complaints form (link) so that we can deal with them as soon as possible and within a maximum period of one month after they are submitted.
You have the right to claim the invoice of your purchase in physical format for any order you place.
9. NULLITY
If any of the clauses of the general terms and conditions of contracting are declared, totally or partially, null or ineffective, such nullity or ineffectiveness shall only affect such provision or the part of it that is null or ineffective and the same shall remain in force in all other respects, and such provision or the part of it that is affected shall be deemed not to be in force. The general terms and conditions shall cease to be valid only with respect to the invalid or ineffective provision, and no other part or provision thereof shall be nullified, invalidated, impaired or affected by such invalidity or ineffectiveness.
10. LANGUAGE
The general terms and conditions are written in Catalan, Spanish, French, Italian and English. In the event of contradiction between these versions, the Spanish version shall prevail.
11. APPLICABLE LAW AND JURISDICTION
The general terms and conditions shall be governed by and construed in accordance with Spanish law.
Likewise, in the event of any conflict or discrepancy arising in the interpretation and/or application of the general terms and conditions of contract, the competent courts shall be those provided for in the applicable regulations regarding competent jurisdiction over consumers and users.
